昆明市衛生執法監督局副局長邵偉民說，從消費心理上講，因為政府部門有規定，消費者和餐廳老板看不到黃標就不會使用他的餐具，所以，消毒廠就盜用這個黃色標記，來欺騙消費者，欺騙餐飲經營者，從而混淆了整個市場。

據了解，這個標識是昆明市衛生部門頒給合格餐具消毒企業的。而昆明市衛生監督部門調查發現，在昆明市公布的合格餐具消毒企業所生產的產品中，並沒有叫“益康”的產品。
記者和昆明市衛生執法人員對這家餐具消毒廠展開調查。這家餐具消毒廠位於一個汽車配件市場的角落裏，一走進工廠，就看見工人在用抹布擦拭洗過的餐具。

昆明市衛生執法監督局副局長邵偉民說，從消費心理上講，因為政府部門有規定，消費者和餐廳老板看不到黃標就不會使用他的餐具，所以，消毒廠就盜用這個黃色標記，來欺騙消費者，欺騙餐飲經營者，從而混淆了整個市場。

昆明市衛生監督部門的執法人員說，他們在消毒餐具行業監管中已采取多種措施，雖然取得了一定成效，卻沒有從根本上改變消毒餐具行業水平較低的狀況。
同時，消毒餐具生產企業如果嚴格按照相關規範，設計生產布局、購買相關設備、將粗洗和精洗區域分開、將消毒和包裝間進行有效的密閉處理，至少需要投入幾十萬元，而建立全自動流水線的成本則更高。如果這些企業不按照規範設計和操作，按照現行的《herve leger sale消毒管理辦法》只能處以5000元以下罰款，違法成本過低也是一直以來消毒餐具行業整體水平難以提高的重要原因之一。

監管存在漏洞
據了解，目前我國有100多個城市在推廣消毒餐具。據全國消毒行業協會統計，截止到去年7月底，全國共成立專業餐具消毒公司1126家，其中江西、湖南、廣西等省區消毒餐具已普及到縣城。
然而，與消毒餐具快速普及的現狀不匹配的是，我國對消毒餐具行業的監管還存在漏洞。目前，衛生、工商等職能部門已著手針對監管中的漏洞和問題采取更有針對性的措施，切實有效地提高消毒餐具行業的整體質量水平。
相關統計數據顯示：手工清洗消毒餐具殺菌合格率只有20.5%；用化學洗滌劑清洗消毒餐具殺菌合格率也只有72.8%，同時殘留在餐具上的化學物質對人體健康還會造成危害；而集中式物理清洗餐具消毒殺菌合格率高達98.5%以上。合格企業生產的合格消毒餐具無疑會大幅提高公眾用餐的衛生安全指數，但現在一些消毒餐具生產企業沒有按照規範操作，提供消毒餐具衛生狀況難以令人放心。
